The deal, written down.
“Not live in 48 hours? You don't pay” means something because every word of it is defined. This is the whole of it: the clock, the pauses, the scope, and what you own.
The guarantee
If your website is not live within 48 build hours and the delay is ours, you don't pay: your deposit is refunded in full. That's the whole guarantee, and these terms define “build hours” and “ours” so it can't be gamed in either direction.
When the clock starts
The 48 build hours start when ALL of these are true:
- The brief call is done.
- Your deposit (50%) has cleared.
- We have your content: business details, the words/notes you want us to work from, your photos/logo (or you've told us to source/write them), and access to your domain (or you've asked us to register one).
When the clock pauses
The clock pauses (the guarantee is not voided, just paused) whenever we are waiting on you:
- Your day-two review: you have 12 hours from receiving the review link to send feedback. Time beyond that doesn't count against the 48.
- Missing content, credentials, or domain access we've asked for in writing.
- Requests to change the agreed scope mid-build (see Scope).
If we can't reach you for 7 days, the project is closed and the deposit is retained as payment for work performed.
Scope
The fixed price covers: five custom pages, design and copy, mobile build, contact forms, maps, analytics setup, SEO basics, one round of revisions. It does not cover: online stores, booking systems, membership areas, ongoing SEO campaigns, or content in languages other than English. Anything outside scope is quoted in writing before any work or billing, never silently added. A mid-build scope change restarts the clock by agreement or is scheduled as post-launch work.
Revisions
One revision round means one consolidated list of changes to the delivered site, within the agreed scope. It doesn't mean a redesign; direction agreed on the brief call stands. Extra rounds are available and quoted first.
Payment and ownership
50% books your slot; 50% is due when the site is ready to launch. The site goes live on your domain when the final payment clears. Until full payment, the site, its design and its code remain ours. If final payment isn't made within 14 days of the site being ready, the launch is cancelled and the deposit is retained for work performed. After full payment the site is yours outright; we keep the right to show the work in our portfolio (tell us if a project is confidential).
Your content
You confirm you own or have rights to everything you give us (words, images, logos) and that it's accurate, especially any claims about your business. We're not liable for content you supplied.
What “live” means
Live means the agreed five pages are published and working on your domain (or our staging URL if your domain access wasn't provided in time; that still counts as delivered on time).
The limits
Our total liability on any project is capped at the fees you actually paid. We're not liable for indirect losses (lost profits, lost data, third-party outages such as domain registrars or hosting providers). We may decline a project before the brief call for any reason with a full refund of anything paid.
The boring line
These terms are governed by the laws of New South Wales, Australia. If a clause turns out unenforceable, the rest still stand. Questions before you book: support@dreamersmedia.co.
